Rent Café Terms and Conditions Updated 10/04/17

  • Each Tenant must occupy the unit; non-occupants are not allowed to be named as Tenants, but may act as lease Guarantors with Landlord’s approval.
  • Tenants and Guarantors must be at least 18 years of age.
  • The number of persons residing in the unit cannot exceed the Landlord’s occupancy standards established in accordance with applicable law.
  • The rental application will not be deemed fully completed until the applicant has (i) paid all application fees and earnest fee, (ii) submitted all requested information including income verification and (iii) submitted any applicable pet information (if seeking permission for the housing of a pet), the DC rent control applicant disclosure form (if applicable) and any other required forms.  Not completing an application within three business days of submitting can result in a rejected application.
  • If the Tenant signs a lease, but does not move in and fails to pay rent, the Landlord reserves the right to apply the security deposit to the rent obligation.
  • The Landlord may run a credit and criminal background before giving final lease approval to an Applicant or Guarantor.
  • If the Tenants’ collective income determined in accordance with applicable law does not met the Landlord’s income standards, then Landlord may allow a Guarantor to be used for income qualification.
  • If the property is subject to DC Rent Control the net monthly charge will not exceed the DC maximum rent plus any applicable surcharges or other applicable charges, less applicable concessions.
  • Businesses are not permitted to be operated out of the unit without Landlord’s prior written consent and proper licensing according to local ordinance, except as required by law.
  • Any pets to occupy the unit must be authorized and permitted in writing by Landlord.
  • Landlord requires renters insurance coverage of minimum $100,000 liability, with Landlord and Bernstein Management Corporation listed as additional insured. Personal property coverage is recommended. Neither the Landlord nor Bernstein Management Corporation will be liable for damages caused to any personal property from water leaks from interior and/or exterior of the building, major or minor floods, smoke and/or fire or any other casualty to the property, except as required by law.
  • Application fees are non-refundable. 
  • Earnest fees are non-refundable unless application is denied based on screening results. The earnest fee will be applied to rent when the tenant takes possession of the premises. 
  • When application has been approved, lease and supported documents must be fully executed and the security deposit must be submitted within three business days. Occupancy is subject to possession being delivered by present occupant.
  • No subletting is permitted.
  • Tenant may not market or advertise or cause to be marketed or advertised its unit or any part thereof for temporary occupancy through the use of any online community marketplace website, social media venue, or any other medium of communication. Examples of such community marketplace and social media websites and applications used to facilitate these prohibited actions include but are not limited to: Airbnb.com, Craigslist.org, Couchsurfing.com, Homeaway.com, Tripadvisor.com, Sublet.com, HomeExchange.com, Facebook, Myspace, Twitter, etc.
